USW Files Complaint in Attempt to Overturn ITC Anti-Dumping Decision
                     Making its debut at an international tyre exhibition was the Malaysian Consortium of Rubber products Sdn Bhd. The Group, otherwise known as Malcorp, is a consortium of Malaysian rubber manufacturers producing
automotive, industrial, commercial and general rubber products. At the show Malcorp were launching a range of pre-cured tread liners, cushion gum, sidewall veneer and camelback manufactured by the consortium’s member companies under the Malcorp brand name. The manufacturer members of the consortium include
names otherwise well known within the retreading sector.
Representing Malcorp at NATRE were CEO Nor Iskandar bin Nordin and retread specialist Lim Sum Teck.
During the North American Tire and Retread Expo the news broke that the United Steelworkers Union in the United States has filed a complaint with the US Court of International Trade seeking a judicial review of the US International Trade Commission’s decision not to impose anti-dumping and/or countervailing duties on Chinese tyres, overturning a previous decision.
The ITC’s decision, made on February 22nd had caused a great deal of surprise and considerable consternation within the US retreading industry at the time.
In its complaint with the Court of International Trade, the USW has asked that the ITC’s decision be overturned on the
grounds that the ITC ignored or misconstrued substantial evidence so that the final determination was “unsupported by substantial evidence and otherwise not in accordance with the law.” The USW also disputes the ITC’s conclusions that the Chinese imports did not cause adverse price effects in the US market and also accused the Commission of failing to explain how its findings complied with a statutory ban on a negative material injury determination simply because an industry remains profitable or its performance has recently improved. The Union is demanding that the CIT re- examine the final determination with a view to issuing a new determination that is consistent with the court’s decision.
